What the Board Doesn’t Want You to Know
The Condominium Authority Tribunal (CAT) does not hand out decisions lightly. When our Corporation lost its case, it was because the facts – and the Corporation’s own words – caught up with them.
Here’s what really happened:
đź“… May 4, 2023 – The First Lie
The Corporation’s lawyers sent us a letter claiming:
“Only dogs that can be carried are permitted in the building.”
Below is an extract from the letter they sent us.

This was false.
- There is no such rule in our governing documents.
- Large dogs live in the building openly.
- Board members walk past them regularly in the backyard.

They knew this was untrue. Yet they made it the foundation of their case.
đź“… October 2023 – Filing the Application
When the Corporation applied to CAT, they repeated the same falsehood:
- Claimed the building only allowed dogs that can be carried.

They also alleged that we had not proven the existence of a disability:

đź“… February 2024 – When the Truth Slipped Out
When I requested to move the case to adjudication (because the Corporation refused to mediate in good faith), the Corporation’s lawyers suddenly shifted their position.
That same day, we received another letter from them stating:
Based on the letters we provided in January and July 2023, they did not dispute that a disability exists.

This was a direct contradiction of what they had just filed at CAT:
- In their application: “No disability proven.”
- In their letter: “We do not dispute a disability exists.”
They pursued a case built on lies until they were forced to retreat.
🚨 Crystal Clear: How They Lied
- May 2023 – Lied in writing: “Only dogs that can be carried are allowed.”
- October 2023 – Repeated the lie in their CAT application.
- October 2023 – Claimed no disability proven, ignoring letters from January & July.
- February 2024 – Admitted those same letters proved disability, contradicting their own filing.

This isn’t a misunderstanding.
It is a pattern of dishonesty: make a false claim, repeat it, and then quietly backpedal once challenged.
🗝️ Why the Corporation Lost
The CAT ruled against them because:
- Their application was based on LIES.
- They acted in bad faith, dragging the community into unnecessary and costly litigation.

The board chose to spend our money defending lies, dragging the community through needless litigation, and then contradicting themselves when caught.
Ask yourself:
- Are these the people you trust to represent you?
- Are these the people you want making financial and legal decisions on your behalf?
