⚖️ When Costs Become a Weapon


Today, we spent an entire day preparing our costs submissions.

This is not busywork. It is time, money, and emotional energy – after years of litigation – diverted yet again to procedure instead of substance.


🛑 Refusal to Stay Costs Pending Appeal

Despite knowing that an appeal is imminent, the corporation refused to consent to a stay of costs.

Let’s be clear about what that means.

Seeking to enforce costs before an appeal is heard is not neutral. It is not procedural housekeeping. It is a pressure tactic – designed to exhaust, intimidate, and discourage appellate review.

That choice was deliberate.


📌 What Happens Next

Because the corporation refused to act reasonably, we will ask the court for a stay of costs pending appeal.

This is precisely why courts retain that power: to prevent costs from being used as leverage against parties who are exercising their right to appeal in good faith.


🔥 Why We Are Appealing – No Matter What

We will be appealing.

Not out of spite. Not out of stubbornness. And certainly not because it’s convenient.

We are appealing because the issues in this case matter:

  • how disabled individuals are treated by institutions,
  • how “civility” is weaponized to excuse discrimination,
  • and how accountability quietly disappears when process is treated as more important than people.

Walking away would be easier. It would also be wrong.

From the beginning, this case has been about more than one dispute, one board, or one building.

It is about whether people with less power are expected to absorb harm quietly – so long as it is delivered politely and wrapped in procedure.

We refuse to accept that.
